US Court Mandates Release of Abrego Garcia from ICE Custody

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration detention.

In her decision, the judge noted that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court challenge center on conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in Tennessee.

Conditions of Freedom

The judge, who was hearing his challenge to deportation in a Maryland district court, determined that he must now comply with the terms of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
